Welcome to the Thomas Callihan Family Association (TCFA)
webpage. Before registering for full access to the website, carefully review
the Terms and Conditions below. Terms may be changed or updated at any time.
You should periodically check this page to make sure you are up to date.
By entering and using the Site, you indicate that you
accept the Terms and that you agree to be bound by and subject to them.
Acceptance of the Terms creates a binding legal agreement between you and the
TCFA and signifies your agreement that you will use the Site only in a manner
that is consistent with the Terms. If you have questions about the Terms,
please contact the webmaster. If you do not agree with the Terms, do not
proceed to register for site access
Access to the website is available to you if you are at
least 13 years of age and you submit certain requested information to the
TCFA including (but not limited to) your correct name and address (addresses
will not be posted) and correct email address. Note that this website is for
personal use only.
A condition of registration is your "Active
Participation" in the website. Active Participation is defined as
accessing the website at least once every 365 days. If your Member account is
inactive for a period of over 365 days, re-registration may be necessary.
The TCFA is committed to ensuring that our Site remains a
useful and safe place to display the genealogy and history of Thomas
Callihan, his descendants, related families and other potentially related
Callihan (including other spelling variations) lines. Every user agrees to
not use the Site to process, digitize, post, upload, store, share or
otherwise display Prohibited Content. Generally, Prohibited Content includes
(without limitation) any of the following:
a.
Content we believe is abusive, deceptive,
pornographic, obscene, defamatory, slanderous, offensive, or otherwise
inappropriate.
b.
Copyrighted material that is used without the express
permission of the owner.
c.
Content that violates or encroaches on the rights of
others.
d.
Content or other material that contains viruses,
worms, corrupt files, Trojan horses and other forms of corruptive code or any
other content, which may compromise the website
e.
Content that advocates illegal activity.
f.
Content that harms minors in any way.
g.
Information on any living individual unless that
information is posted by such individual, or that such individual has granted
written permission to post such information.
h.
Any links to the above.
The TCFA has the sole discretion to determine whether
Content is Prohibited Content, and any Content will be subject to examination
from time to time.
In no event shall the TCFA (including its officers,
directors, and agents) be liable for claims of any nature, whether direct or
indirect, arising from or related to any Content made available on or through
the Site, including (without limitation) errors or omissions in such Content,
and loss or damages incurred as a result of use of such Content.
You agree not to sell, resell or exploit any part of the
Site or to access the Site for any commercial purposes.
You remain the owner of all Content that you submit to the
Site, and as a condition of registration, you represent and warrant to the
TCFA that you are the owner of the copyright to Content you submit to the
Site or that you have written permission from the copyright owner to submit
such Content.
All the information, Content, image files, software and
materials offered on the Site are protected by U.S. and international copyright
laws and by other applicable laws. You understand that the TCFA is unable to
provide you with permission to copy, display or distribute material for which
you do not own the copyright. You may not copy or distribute such material
without the written consent of the copyright owner, and you are solely
responsible for any copyright violations that you may incur as a result of
your activities on the Site. The TCFA has the absolute right to terminate
your registration or exclude you from the Site if you use the Site to violate
the intellectual property rights of third parties.
Some materials are in the Public Domain such as names of
individuals, dates of birth and death and other information that is published
in census records, birth and death certificates, and marriage certificates,
to name a few. Information commonly in the public domain is not protected by
copyright.
You agree to indemnify, defend and hold harmless the TCFA
(including its officers, directors, agents, and volunteers) from and against
all losses, expenses, damages and costs, including reasonable attorneys'
fees, resulting from any violation of these terms or any activity related to
your account (including negligent or wrongful conduct) by you or any other
person accessing the website using your account.
You agree and acknowledge that The TCFA, in its sole
discretion, may terminate your use of the website at any time, without
notice, for any reason, including but not limited to:
a.
Conduct violating these Terms
b.
Conduct that the TCFA believes is harmful to other
website users and Conduct that violates the letter or spirit of these Terms.
Further, you agree that the TCFA shall not be liable to
you for any termination of your access to the website.
These Terms constitute the entire agreement between you
and the TCFA and govern your use of the website
The failure of the TCFA to exercise or enforce any right
or provision of the Terms shall not constitute a waiver of such right or
provision.
